Regular Monthly Meeting
September 14, 2009


The regular monthly meeting for the month of September was called to order at 6:00 p.m. by the Honorable Mayor Don R. Emmons.

Members present: Clemontine F. Washington, Mayor Pro-Tem; Levern Clancy, Jr., Councilman; Henry O. Stevens, Sr., Councilman; and Jim H. Woods, Councilman.

The mayor led the council and audience in reciting the Lord’s Prayer and the Pledge of Allegiance to the United States Flag.


Corrections to Minutes – Councilman Woods stated there is one sentence under Terry Doyle – Street lights for Windy Oaks Court to be corrected. Quote “during the inspection one person was arrested”.

Approval of Minutes- It was moved by Mayor Pro-Tem Washington and seconded by Councilman Stevens to adopt the minutes with the above corrections. The motion passed unanimously.

Old Business

A. St. Lights – Councilman Woods read the survey that was taken by Mayor Pro-Tem Washington, Councilman Clancy, and Councilman Woods. These lights were not included on the 2009 fiscal budget. Mayor Pro-Tem Washington asked Mrs. Gwendolyn Lowe, the Finance Director could we afford to install two lights on poles that already exist. Councilman Clancy moved to install two street lights at Edgewater and Windy Oaks Court. Councilman Woods seconded the motion. The motion passed unanimously.

B. Prison Labor – Mayor Emmons stated that we need a public hearing to get the community opinion. Mayor Pro-Tem Washington wanted to know is this for 2009? Mayor Emmons stated for 2009 and 2010. Councilman Woods ask the Finance Director could we afford prison labor. Ms. Lowe stated that every city is crying for this service.
This is a win-win situation. Councilman Woods asked had she added in the expenses. Mayor Emmons stated that we would have a public hearing to hear from the citizens? The date of the public hearing will be announces at a later date.
C. Divine Trinity Personal Care Home #2 Occupational License – Mrs. Debra Attical presented the occupational license of the Divine Trinity Personal Care Home # 2 Mrs. Townsend stating that it would not be a half way house. Personal care homes are for senior citizens and other that require personal care. Councilman Clancy made the motion to approve the occupational license. Councilman Stevens seconded the motion. The motion passed unanimously.

D. Request for Temporary Sign for Midway United Methodist
Church – Councilman Stevens made the motion to approve one temporary BBQ signs being placed off the roadway at the old historic Midway Church, and one be placed on the edge of the right-of-way in front of the Midway United Methodist Church. Councilman Clancy seconded the motion the motion passed unanimously. This motion passed unanimously.

New Business

A. Duane Fairfax – Hickory Hill Subdivision – Mayor Emmons stated that the letter he signed and Attorney Richard Braun presented to the courts stated that Mr. Duane Fairfax was looking for a Resolution only. Mr. Fairfax presented an illustration showing the current drainage issues at Hickory Hill Subdivision. Mr. Jim Bishop a resident from Hickory Hill Subdivision also had questions about the calculations of the water bills for the month of August. After a lengthy discussion. Attorney Richard Braun stated he would speak with anyone who was not represented by the courts.

B. Darnell Flemming – Emergency Weather Sirens & Speed Bumps – Mr. Flemming wanted to know what the city has in place in the event of an emergency weather. Mr. Flemming also stated that speed bumps are needed in each of the subdivision.

C. Gwinnett Place / Gloucester – Moved to Executive Session

D. 2010 Financial Planning – Ms. Lowe will contact the council in reference to the dates at a later date.

E. Intergovernmental Agreement on Debris Removal – Mayor Pro-Tem Washington move to adopt the Intergovernmental Agreement on Debris Removal. Councilman Woods seconded the motion. This motion passed unanimously.

F. Gateway Design Review Board Appointment – Mayor Emmons stated that Danny Creasy from the Business and Sally Dowlen the Civil. Mayor Pro-Tem Washington made the motion to
Approve the two appointments. Councilman Clancy seconded the motion. The motion passed unanimously.

Williams Muse is the spoke’s person for the New Dollar General store on Butler’s Ave. Mr. Muse is proposing the 25ft set back.

G. Executive Session – Councilman Stevens made the motion to go into executive session to discuss land. Councilman Clancy seconded the motion. This motion passed unanimously. After a brief
Discussion Councilman Stevens made the motion to adjourn executive session. Councilman Woods seconded the motion. This motion passed unanimously. Mayor Pro-Tem Washington moves that the City of Midway place a moratorium on Construction in Gwinnett Place/Gloucester on and new businesses or ventures until the present zoning are re-evaluated. Councilman Clancy seconded the motion. This motion passed unanimously.

Adjournment –

It was moved by Councilman Stevens seconded by Councilman Clancy
to adjourn the regular monthly meeting. This motion passed unanimously. The meeting adjourned at 8:44 p.m.
